Terms of Service

These Terms of Service govern your access to and use of EnglishTestNow, including the public website, user dashboard, mock tests, AI feedback tools, add-ons, speaking or writing coach features, and any related digital services or communications.

By using the service, creating an account, starting a trial, or purchasing a paid product, you agree to these terms. If you use the service for an organization or on someone else's behalf, you represent that you have authority to bind that person or organization.

EnglishTestNow and, for paid orders, the merchant or legal entity shown on your checkout, invoice, or receipt is the party providing the applicable paid service. If you do not agree to these terms, do not use the platform.

You must provide accurate registration and billing information, keep your credentials confidential, and promptly update your information if it changes. You are responsible for activity that occurs under your account unless you promptly report unauthorized access.

• You may not share accounts, resell access, or let multiple users use one paid seat.
• You must be legally able to enter a binding agreement where you live.
• We may suspend, restrict, or terminate access where reasonably necessary for security, fraud prevention, payment disputes, abuse, or violation of these terms.

EnglishTestNow is an educational preparation platform. It provides practice questions, mock tests, AI-assisted feedback, progress tools, and coaching workflows intended to help users prepare for English-language exams.

The service is not an official exam body, school, university, immigration authority, licensing authority, or legal adviser. Scores, band estimates, coaching suggestions, transcripts, and AI outputs are informational only and are not official test results or guaranteed predictors of real-world outcomes.

We do not guarantee any score increase, admission result, visa decision, job outcome, or uninterrupted service availability.

EnglishTestNow is an independent preparation service. We are not affiliated with, endorsed by, or sponsored by IELTS (British Council, IDP, Cambridge Assessment English), ETS (TOEFL), Paragon Testing Enterprises (CELPIP), Pearson (PTE), or any other official exam body, immigration authority, or testing organization.

Exam names, acronyms, and logos referenced on the platform are third-party trademarks used for nominative and descriptive purposes only to help you identify which exam format you are preparing for. We do not claim ownership of those marks.

Practice content, mock tests, scoring estimates, and AI feedback are original or internally developed simulations intended for study. They are not official exam materials, not leaked or live test content, and not substitutes for an official score report or admission, visa, licensing, or employment decision.

Any band scores, point estimates, or performance labels shown in the product are study aids only. They may differ from official results and should not be treated as guaranteed predictors of outcomes on a real exam.

Paid memberships, add-ons, speaking-coach subscriptions, and one-time digital top-ups are billed through third-party payment processors such as Stripe. Prices, billing intervals, taxes, and included features are shown in checkout or on the relevant product page.

If you enroll in an automatically renewing subscription, you authorize recurring charges until you cancel. You can manage eligible subscriptions through the billing portal made available in the dashboard. Cancellation stops future renewal charges but does not undo charges already incurred for the current billing period unless required by law.

Because the platform delivers digital services immediately, access may begin as soon as purchase is completed. Your use of a paid plan, add-on, credit, drill, AI review, or similar entitlement may make that purchase non-refundable under the Refund Policy.

Signed-in users may access limited free section practice before purchasing premium membership. Full mock tests, unlimited section practice, and the complete premium toolkit require an active paid membership unless we state otherwise on the product page.

If we offer a paid trial or introductory period, the checkout or product page will show when billing begins and how to cancel before the first charge. Canceling before billing starts stops the upcoming charge. If you access premium-only features during a trial, that use may count as use of a digital product under the Refund Policy.

Speaking-coach subscriptions, drill top-ups, and other add-ons may be sold as separate products with their own billing intervals, usage limits, and renewal rules shown at checkout.

All refund questions are governed by the Refund Policy, which forms part of these terms. In general, digital products are final once they have been accessed, activated, or used.

• No refund is owed for a billing period that has already started and been used.
• No refund is owed for add-ons, credits, top-ups, or one-time digital unlocks once used.
• We may still issue refunds or credits where there is a duplicate charge, a verified billing error, total failure of initial access without material use, or a legal obligation to do so.

Nothing in these terms limits mandatory consumer rights that cannot legally be waived.

You may use the service only for lawful, personal, internal educational purposes. You may not:

• copy, scrape, republish, resell, or commercially exploit platform content;
• systematically download, index, mirror, archive, or build datasets from question banks, prompts, audio, layouts, or other platform materials;
• use platform content to train, fine-tune, or evaluate machine-learning models without our prior written permission;
• reverse engineer, probe, or interfere with platform security or rate limits;
• use bots or automation to create accounts, harvest content, or manipulate usage;
• share credentials, white-label access, or resell seats without authorization;
• access non-public areas for competitive benchmarking, cloning, or unauthorized reproduction of the service;
• upload unlawful, infringing, abusive, or malicious content;
• attempt to bypass subscription limits, usage controls, or account restrictions;
• use the platform to cheat on live exams or violate third-party exam rules.

We may investigate suspected misuse and take proportionate action, including suspension, cancellation of entitlements, blocking access, or pursuit of injunctive relief and other remedies permitted by law, in addition to referral to payment, hosting, or law-enforcement partners where appropriate.

You retain rights you already hold in text, audio, or other material you submit to the platform. You grant us a non-exclusive, worldwide, royalty-free license to host, process, transmit, store, reproduce, and display that material only as reasonably necessary to operate, secure, support, and improve the service.

EnglishTestNow and its licensors retain all rights in the platform, software, prompts, question banks, layouts, visual assets, branding, and generated service content, excluding your own submissions. We grant you a limited, revocable, non-transferable license to use the service for its intended purpose while these terms remain in effect.

If you believe content on the platform infringes your copyright or other intellectual- property rights, contact us through the support chat at englishtestnow.com with enough detail for us to evaluate the report, including:

• identification of the work you claim has been infringed;
• identification of the material you claim is infringing and where it appears;
• a statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or the law;
• a statement that the information in your notice is accurate and, if you are acting on behalf of a rights holder, that you are authorized to do so;
• your contact information.

We may remove or restrict access to reported material and terminate repeat infringers where appropriate. We may also take action against bad-faith or abusive notices.

We may update, modify, suspend, or discontinue any feature at any time for product, operational, legal, quality, or security reasons. We may also impose reasonable usage caps, storage limits, geo-restrictions, or plan-specific feature differences.

Some features may be labelled beta, preview, or experimental. Those features may be less stable, may change quickly, and may be withdrawn without notice.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless EnglishTestNow and its affiliates, licensors, service providers, and personnel from and against claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to:

• your content, submissions, or communications on the platform;
• your violation of these terms or applicable law;
• your infringement or misappropriation of third-party rights;
• your misuse of AI outputs or unauthorized sharing of paid content;
• your use of the platform in a way that violates exam rules or facilitates cheating on live exams.

We may assume control of the defense of any matter subject to indemnification, and you agree to cooperate. Nothing in this section limits rights that cannot legally be waived or altered by contract.

To the maximum extent permitted by law, the service is provided on an "as is" and "as available" basis. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, perfectly secure, or compatible with every device, browser, jurisdiction, or testing scenario. AI outputs may be incomplete, inaccurate, or inconsistent and should be reviewed before you rely on them.

To the maximum extent permitted by law, EnglishTestNow and its affiliates, licensors, service providers, and personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, exam outcomes, immigration outcomes, or loss of goodwill.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service will not exceed the greater of the amount you paid us for the relevant service during the 12 months before the event giving rise to the claim or USD 100.

Some jurisdictions do not allow certain exclusions or limitations, so part of this section may not apply to you. In that case, the limitation applies only to the fullest extent permitted by applicable law.

These terms are governed by the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law rules that would require a different result, except where mandatory local law requires otherwise.

Except where prohibited by mandatory consumer protection, privacy, or refund law in your country, you agree that disputes arising out of or relating to the service will be brought exclusively in the courts located in Alberta, Canada, except where mandatory consumer protection, privacy, or refund law in your country requires a different forum.

If a mandatory rule in your jurisdiction gives you the right to bring a claim in another forum, require a different refund outcome, or prevents a limitation in these terms from applying, that mandatory rule prevails over any conflicting provision here.

Electronic communications. You consent to receive communications from us electronically, including account notices, billing messages, service updates, and legal notices posted on the site or sent to the email associated with your account.

Assignment. We may assign or transfer these terms or our rights and obligations in connection with a merger, acquisition, financing, reorganization, or sale of assets. You may not assign these terms without our prior written consent.

Severability. If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in effect.

Force majeure. We are not liable for delay or failure to perform caused by events beyond our reasonable control, including outages, provider failures, labor disputes, natural events, or government action.

Third-party services. Authentication, payments, analytics, hosting, email, and AI features may be provided by third parties under their own terms and privacy policies. We are not responsible for third-party services we do not control.

Export and sanctions. You represent that you are not located in, organized under the laws of, or ordinarily resident in a jurisdiction subject to comprehensive trade sanctions, and that you are not prohibited from using the service under applicable export-control or sanctions laws.

You may stop using the service at any time. We may suspend or terminate access if you breach these terms, create legal or payment risk, misuse the platform, or where we are required to do so by law or service-provider obligations.

Sections that by their nature should survive termination will remain in effect, including billing obligations, refund rules, intellectual-property rights, disclaimers, liability limits, indemnification, governing-law and dispute provisions, and provisions concerning prior use of the service.

We may update these terms from time to time. Material changes take effect when posted on this page unless a later date is stated. Your continued use of the service after the effective date means you accept the updated terms.
